Terms and Conditions
1. Definitions
1.1 “Buyer” means the individual or organisation who buys or agrees to buy the Goods and/or Services from the Supplier.
1.2 “Consumer” shall have the meaning ascribed in Section 12 of the Unfair Contract Terms Act 1977.
1.3 “Contract” means the contract between the Supplier and the Buyer for the sale and purchase of Goods and/or Services incorporating these Terms and Conditions.
1.4 “Goods” means the articles that the Buyer agrees to buy from the Supplier.
1.5 “Services” means the services that the Buyer agrees to buy from the Supplier.
1.6 “Supplier” means UK Amusement Supplies, which owns and operates www.ukamusementsupplies.co.uk.
1.7 “Terms and Conditions” means the terms and conditions of sale set out in this agreement and any special terms agreed in writing by the Supplier.
1.8 “Website” means www.ukamusementsupplies.co.uk.
2. Conditions
2.1 Nothing in these Terms and Conditions shall affect the Buyer’s statutory rights as a Consumer.
2.2 These Terms and Conditions shall apply to all contracts for the sale of Goods and/or Services by the Supplier to the Buyer and shall prevail over any other documentation or communication from the Buyer.
2.3 Acceptance of delivery of the Goods shall be deemed conclusive evidence of the Buyer’s acceptance of these Terms and Conditions.
2.4 Any variation to these Terms and Conditions shall be inapplicable unless agreed in writing by the Supplier.
2.5 Any special conditions applying to the provision of the Services are set out in the Schedule to this agreement.
2.6 Any complaints should be addressed to the Supplier’s address stated in clause 1.6.
3. Ordering
3.1 All orders for Goods and/or Services shall be deemed to be an offer by the Buyer and are subject to acceptance by the Supplier. The Supplier may choose not to accept an order for any reason.
3.2 Where Goods are not available, the Buyer will be notified and may choose to wait or cancel the order for a full refund within 28 days.
3.3 Once an order is placed and confirmed by email, no edits can be made (including shipping address changes, order revisions, adding items, or combining orders). If incorrect details are submitted, the Buyer must notify the Supplier for cancellation and refund before placing a new order.
4. Price and Payment
4.1 Prices are as stated on the Website and exclude delivery unless otherwise stated.
4.2 The total purchase price, including VAT and delivery charges (if applicable), will be displayed before order confirmation.
4.3 The Supplier will confirm order details by email.
4.4 Payment must be made during checkout.
4.5 If any payment is late, rejected, or refused, the Supplier may suspend services or deliveries until payment is received.
5. Rights of Supplier
5.1 The Supplier reserves the right to update prices at any time but will ensure accuracy at the point of order.
5.2 The Supplier reserves the right to withdraw any Goods and/or Services from the Website at any time.
5.3 The Supplier reserves the right to cancel an order if delivery requirements are not met (e.g. no valid arcade address).
6. Delivery
6.1 Goods can only be delivered to amusement arcades and not to residential addresses.
6.2 UK orders are normally dispatched within 2 working days of acceptance.
6.3 If a delivery date cannot be met, the Buyer will be notified and may agree to a new date or receive a full refund.
6.4 Delivery dates are estimates only, and the Supplier is not liable for delays.
6.5 Delivery is made to the address provided, and the Buyer must ensure readiness to receive the Goods.
6.6 If Goods are returned due to incorrect details or failed delivery, re-delivery costs are the Buyer’s responsibility.
6.7 Risk passes to the Buyer upon delivery or attempted delivery.
6.8 Ownership of Goods remains with the Supplier until full payment is received.
7. Cancellation and Return
7.1 Orders may be cancelled before dispatch for a full refund within 28 days.
7.2 Goods must be inspected upon receipt and issues reported within 7 working days.
7.3 Defective Goods must be returned within 28 days for replacement or refund.
7.4 The Supplier may arrange collection of defective Goods where applicable.
7.5 Consumers may cancel within 7 working days (excluding unsealed software, audio, or video products).
7.6 Returned Goods must be properly packaged and insured; return costs are generally the Buyer’s responsibility.
7.7 The Supplier may arrange collection in certain cancellation cases.
7.8 Returns must clearly display the order number.
7.9 Damage caused by the Buyer will be chargeable.
7.10 Custom or made-to-order products are non-refundable.
8. Limitation of Liability
8.1 The Supplier’s liability is limited to the price of the Goods and/or Services and excludes indirect or consequential losses.
8.2 Nothing in these Terms excludes liability for death or personal injury caused by negligence.
9. Waiver
9.1 Failure by the Supplier to enforce any rights shall not affect future enforcement.
10. Data Protection
Customer details (including name, address, and payment history) may be shared with credit reference agencies and processed in connection with the supply of Goods.
11. Severance
If any provision is found invalid or unenforceable, the remaining provisions shall remain in full effect.
12. Changes to Terms
The Supplier may update these Terms at any time, but existing agreements will not be affected.
13. Governing Law
These Terms are governed by the laws of England, and disputes are subject to the jurisdiction of the English courts.
14. Custom Made / Bespoke Products
14.1 No refunds are available for bespoke or made-to-order products, including custom redemption tickets.
14.2 Once manufacturing has begun, orders are final and cannot be cancelled or amended.
